It is understood that "16 Zhongshan lighting factories have been accused of infringement" recently. Looking at the entire LED industry, there are countless cases of such "patent pirates" robbing patents in the lighting field. The fact that many companies have been caught in the act highlights the general lack of intellectual property protection in the entire industry. The cunningness of "patent pirates" and the weak awareness of intellectual property protection and rights protection have led to "patent pirates" succeeding frequently and becoming extremely rampant.
At present, many lighting companies and even leaders in the industry are often ridiculed for "plagiarism", and there are even some ridiculous fallacies, such as: "Plagiarism is successful, copying is excellent, and no one accuses you of plagiarism, you are awesome", "Plagiarism is the mother of innovation", "It is wrong to copy one's own people, but it is not guilty to copy foreigners"... This is the strange state of today's society. This is closely related to the fact that companies do not realize the importance of intellectual property rights, but simply focus on immediate benefits and try to rely solely on models and channels.
For enterprises, it is not fatal to be at a disadvantage in competitive means such as price and marketing channels, but once they fall into patent litigation, there will be a survival crisis. Industry veterans said that many domestic lighting companies have seized the market through price wars, concept wars, channel wars and other marketing techniques, focusing more on cost, price and other aspects. A newly designed lamp is launched, and within a few days, imitation versions are everywhere. There is insufficient attention to long-term and fundamental issues such as patents, and the lack of careful and effective strategic deployment. This is related to the company's weak awareness of intellectual property protection and the characteristics of intellectual property itself.
We may feel exhausted by the cruel reality, but our strong desire to survive prevents most of us from becoming Boyi or Shuqi. Cao Xueshan, R&D Director of Zhongshan Qilang Lighting Factory Co., Ltd., said that good designs are hard-won. Only by better respecting design and protecting intellectual property rights can the legitimate rights and interests of manufacturers and merchants be protected. If there is no infringement, there is no need to protect rights. Rights protection is only a means and not an end. We hope that rights protection and industrial regulations can promote the healthy development of the market and allow good designs and products to continue to emerge.
Recently, Zhongshan City has proposed to promote the transformation of lighting and other industries from "manufacturing" to "intelligent manufacturing" and even "creation", and from "selling products" to "selling ideas." However, in the field of LED applications, the most urgent needs are R&D technical talents in optics, appearance design, electronics, structure, etc., lighting application design talents, and innovative talents (including technological innovation and business model innovation, etc.). The "talent shortage" hinders the healthy development of lighting companies. Yi Yongchen, chairman of Changsha Daming Optoelectronics Technology Co., Ltd., pointed out that corporate culture and management model are the key to retaining talents, especially the stability of core talents directly attracts the stability of grassroots employees. If the problem of "talent shortage" is not solved, no matter how big the industry develops and how complete the industrial chain is, it can only linger on the periphery.
Judging from the development history of the lighting industry, lighting, as a composite industry that integrates home furnishing, architecture, home appliances, and light source art, needs to accelerate its research and development in order to develop rapidly. In this regard, Cao Xueshan shared three points of experience on intellectual property protection: For example, new design drawings can be timestamped by mailing them to the post office and sent back to the company headquarters and overseas branches for preservation, thereby obtaining global copyright. For key products, apply for Chinese copyright certificates through the Zhongshan Ancient Town Chamber of Commerce to strengthen protection; second, speed up applications for intellectual property protection. For example: rapid processing and authorization of patents through the Zhongshan (Lighting) Intellectual Property Rights Protection Center in China; thirdly, self-protection can be strengthened by filing with domestic and foreign customs. For lighting companies that are establishing their brand image, they should constantly improve their technology, do more design innovation, be able to introduce new products, and impress consumers with good products.
