LED white light patent licensing and technology development trends

"At the 2014 China International LED Market Trend Summit Forum hosted by the Guangzhou International Lighting Exhibition, Dr. Dongmen Lingyi, Director of Intellectual Property Projects of Toyota Gosei Global Market Sales Department, gave a speech on the theme of "LED White Light Patent Licensing and Technology Development Trends".

 Now some patents have expired or will expire in the next few years, and other patents have many loopholes. With the global development trend of patents and the increasing number of patent lawsuits, patent issues will eventually be solved by technology research and development. For example, the basic white LED YAG patent will expire in 2017, which also brings new opportunities and challenges to the new round of patent promotion competition," said Dr. Dongmen Lingyi. Currently, the basic LED patents are in the hands of five major international manufacturers: Philips, Nichia, Osram, Toyoda Gosei, and CREE. They form a patent protection wall through mutual patent authorization, thereby achieving the purpose of controlling the industrial chain and supply chain. Companies outside the patent wall will face the threat of litigation and difficult challenges of licensing fees.

Nichia tends to enforce patent rights through litigation but rarely grants licenses. Litigation mainly focuses on LED chip and white LED patents, but often uses specific patent families. Osram and Cree are both inclined to file lawsuits and are willing to sign licensing agreements with manufacturers. Lumileds, which obtained patent licenses as a member of the Philips Group, has not filed a lawsuit regarding blue light LED. It only filed a lawsuit with the SSC in March 2011. Toyoda Gosei is inclined to grant patent licenses. Currently, it has jointly proposed a technical patent for using blue LED and silicate phosphor to form white light with Austria's Tridonic Company, Germany's Leuchtstoffwerk Breitungen Company, and Litec GbR Company. It is suitable for Austria, Europe, Japan, the United States, South Korea, Taiwan, China, Russia, Malaysia and India. A total of more than 30 LED manufacturers have obtained the right to use these patented products.
